We are currently seeking a high calibre professional to join our team as a Senior Legal Counsel, Litigation and Regulatory Enforcement, ASP.
Role Context
- The jobholder reports to the Managing Associate General Counsel, Litigation and Regulatory Enforcement ASP with responsibility for litigations for Asia Pacific region and is expected to take on a varied contentious caseload, including contentious regulatory matters, and with a reasonable degree of autonomy
- The jobholder is expected to manage legal risk in accordance with established policies and procedures. The diversity of HSBC's business, its geographic spread and the constant changes internally and externally means the diversity of matters which the jobholder is required to manage and advise on is very wide
- The role requires an understanding of the structure of the HSBC Group and its culture and the ability to handle increasingly complex legal issues
- The jobholder must also establish close mutually supportive working relationships with other members of the HSBC Legal team and the Global Legal Function
- To provide legal advice, guidance and support on a variety of litigations, contentious regulatory matters and other contentious matters to ensure that HSBC's exposure to legal risk is managed
Impact on Business
- As part of the regional Litigation and Regulatory Enforcement Team in Asia Pacific
- To act as a specialist lawyer, provide counsel and legal support on all relevant aspects in the contentious sphere relating to HSBC's business in Hong Kong, including court proceedings and processes, Financial Dispute Resolution Centre matters, claims, and contentious regulatory matters
- To be considered a trusted adviser to HSBC by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner for assigned areas
- Liaise and collaborate with the business, lawyers across the HSBC network and other functions in relation to litigation matters
- Develop and deliver training on dispute risks as needed
- Identify emerging trends in relation to litigation and regulatory enforcement actions and develop approaches for mitigating potential legal risk
- Provide prompt, commercial, practical legal advice in connection with claims, disputes and contentious regulatory matters
- Be proactive in the provision of legal support and in advising the business promptly of material legal developments and their implications
- Ensure legal and business management are fully briefed on major issues arising in relevant business area and major legislative and case law changes in area of expertise
- Provide support on business initiatives as appropriate when required by Line Manager and ensure that relevant legal risks are considered and analysed
- Maintain and develop positive and professional working relationships with all team members within the legal department, and business departments for which the jobholder is responsible
- Participate effectively as part of the HSBC legal team
- Share legal knowledge and best practices with legal colleagues
- May manage internal support staff as appropriate
- Provide legal services in a cost-effective manner
- Manage the legal risk in HSBC legal and business departments for which the jobholder is responsible, to ensure that the interests of the HSBC Group are adequately protected
- Assist the business to remain compliant with legal risk management requirements set out in HSBC's policies and procedures
- Awareness of the operational risk scenario associated with the role and to ensure that all actions during employment with HSBC take account of the likelihood of operational risk occurring
- Leadership over all regulatory and compliance matters and the management of operational risk
- Solid knowledge and experience in handling and advising litigation and regulatory investigation matters is essential (preferably with Hong Kong experience). Knowledge of and experience in arbitration laws will be a plus
- Qualified lawyer (6-10 PQE)
- Chinese language capability is preferred
- Excellent communication and inter-personal skills with lawyers and businesses across diverse geographies and cultures
- Lateral thinking - with an ability to interpret and solve complex issues
- Superior writing skills
- Strong ability to prioritize
- Detail-oriented and meticulous in follow-up and work product
